ORDER :

The application is filed by wife for transfer of H.M.P. No. 152/2010, presently pending in the Court of Civil Judge, Senior Division, Barshi, District Solapur to the Court from Beed where the wife is living. Heard both the sides. 2.

It is the case of wife that the distance between Gevrai, her place of residence and Barshi is more than 200 k.m. and she cannot afford to spend on travel, attendant etc. as she has no source of income. It is her case that she has filed one proceeding under provisions of Domestic Violence Act and that proceeding is pending in Gevrai Court. The distance between Gevrai and Beed is 45 k.m.

In view of aforesaid contentions, this Court holds that the matter needs to be transferred to the Court from Beed. Care of convenience of husband can be taken and if he desires, the matter pending in the Court of Gevrai can be transferred after filing of the appropriate proceeding by the husband in the proper court.

So, the application is allowed. H.M.P. No. 152/2010, presently pending in the Court of Civil Judge, Senior Division, Barshi is withdrawn from that Court and is transferred to the Court of Civil Judge, Senior Division, Beed. Parties are to appear in the new Court on 24.6.2016.
