This matter is heard for some time.

Learned Advocate for the petitioner submits that considering the prayer clause "C", the review application dated 08/12/2008 pending with respondent No.1 can be disposed of on its own merits by hearing the petitioner. He further submits that as the said application is almost 9 years old, the petitioner would prefer a fresh application on the same lines and submit it to respondent No.1 and the same can be decided.

Considering the above, this petition is disposed of. In the event, the petitioner prefers an application within 6 weeks on the khs/NOV. 2017/8907

lines of the application dated 08/12/2008, respondent No.1 shall thereafter initiate appropriate proceedings as is permissible in law and shall consider the said application after hearing the concerned parties as expeditiously as possible and preferably within a period of 4 months from its filing.

The ad-interim relief granted earlier by this Court on 30/09/2010 shall be continued for a period of 8 weeks from today. If the petitioner files an application within the time frame noted above, he would be at liberty to request respondent No.1 for interim relief. ( SUNIL K. KOTWAL, J. ) ( RAVINDRA V.
