As we had observed in the yesterday's order, Mr. Karlekar learned advocate who appears for the respondent Nos. 4 and 5, on instructions, submits that today is the last date for filling in the options by the students in the CAP round-1 and it is not possible to include the petitioners institutions in the first round as that would change the seat matrix and may cause prejudice to the students. On instructions, he also submits that if the petitioners comply with the other necessary requirements its colleges would 1/2

The petitioners could get the approvals from the concerned University only on 09.08.2023 when already the seat matrix was published and the choice filling had begun which is to end today for the CAP round-1. Only with a view to explore if anything can be done to include the petitioners colleges in the CAP round-1, we had, as observed above, asked Mr. Karlekar, who appears for the respondent Nos. 4 and 5 to take instructions. 4.

Since the petitioners though submitted applications with the University for affiliation for the academic year 2023-2024 on 29.09.2022, for the reasons unknown, atleast not disclosed in the petitions, could get the affiliation only on 09.08.2023. If such is the state of affairs, the petitioners should blame themselves for the delay and latches. Now that the respondent Nos. 4 and 5 have expressly mentioned that they would be including petitioners' colleges in the CAP round-2, nothing survives. 5.

The Writ Petitions are disposed of by accepting the statements of the learned advocate for the respondent Nos. 4 and 5 as an undertaking to the Court.
