The challenge is to an order granting stay by learned Additional Divisional Commissioner, Chh. Sambhajinagar in an appeal preferred by respondent No.1. Respondent No.1 is elected Sarpanch of Grampanchayat, Sawali, Tal. Biloli, Dist. Nanded. The petitioner had filed dispute seeking disqualification of respondent No.1 in view of section 14(1)(J-3) of the Maharashtra Village Panchayats Act. The learned Collector allowed the dispute holding respondent No.1 as disqualified for holding post of Sarpanch of Grampanchayat. Against the said judgment of the learned Collector, respondent No.1 approached the learned Additional Divisional Commissioner, wherein the stay is granted. 02.

It is prayed in this petition that the order granting stay to be quashed and set aside.

This Court does not find any reason to interfere in the order passed by the learned Additional Divisional Commissioner. The petition can be conveniently disposed off by requesting the learned Additional

( 2 ) wp9431.24 Divisional Commissioner to dispose off the appeal as early as possible and preferably within two months from today.
