This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0004/2022, registered at Himayatnagar Police Station, District Nanded, for the offences punishable under Sections 302, 307, 324, 326, 504, 506, 109, 143, 147, 148 read with 34 of the Indian Penal Code and under Section 4/25 of the Arms Act.

Heard. Perused the First Information Report (FIR) and the statements recorded under Section 161 Cr.P.C. of the relevant

(( 2 )) 952-BA-1548-2022 witnesses. The applicant has not been attributed with any overt act therein. However, in a statement recorded under Section 164 Cr.P.C., he is alleged to have caught hold of the deceased. Considering this variance in the statements of the witnesses and the fact that on investigation, the charge-sheet has been filed. It will take time for commencement and conclusion of trial. Hence, following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.0004/2022, registered at Himayatnagar Police Station, District Nanded, for the offences punishable under Sections 302, 307, 324, 326, 504, 506, 109, 143, 147, 148 read with 34 of the Indian Penal Code and under Section 4/25 of the Arms Act, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.

(iii)The applicant shall not tamper with the prosecution evidence.
