The petitioner is objecting to the order passed by the Collector prohibiting him from participating in the meeting convened for electing Sarpanch and Up-Sarpanch, which was scheduled to be held on 31.08.2015, although concerned authority i.e. Deputy Collector ought not to have restrained an elected representative from performing his functions as elected representative.

Since the meeting, which was scheduled to be held on 31.08.2015, is already over, we do not wish to cause interference in the matter except declaring that the action of the Deputy Collector is bad in law. The petitioner shall not be prohibited from functioning as an elected representative until passing of further orders on the disqualification application moved against the petitioner and subject to result thereof. In view of above clarification, writ petition stands disposed of.
