By this application filed under section 439(2) of the Code of Criminal Procedure Code, applicant seeks cancellation of anticipatory bail granted in favour of respondent Nos. 2 and 3 by learned Sessions Court, Ahmednagar in Crime No.153 of 2022 registered with MIDC Police Station, Ahmednagar for the offences punishable under sections 306, 504 read with 34 of the Indian Penal Code.

Heard the learned advocate for the applicant, learned Additional Public Prosecutor for Respondent No.1 and learned
938-ACB-182-22 advocate for respondent Nos. 2 and 3. Perused the papers of investigation. Perused the investigation papers. 3.
FIR is lodged on 08/03/2022, and the Sessions Court, after considering merits of the prosecution case, granted anticipatory bail to respondent Nos.2 and 3 by order dated 06/05/2022.

It is informed at Bar that before filing of the present application, charge-sheet came to be filed and the case is numbered as Sessions Case No.191 of 2022 and summons are already issued to the accused persons and matter is pending for their appearance.

Considering the allegations made in the FIR and the material collected during the course of investigation, and the fact that Sessions trial is pending, it is not desirable to cancel anticipatory bail granted in favour of respondent Nos. 2 and 3. 6.
Application is, therefore, dismissed.
