The petitioner who is in the employment of the respondents - the Maharashtra State Electricity Transmission Company Ltd. is seeking correction of the service record regarding his date of birth which mentions it as 01-01-1970 even when he was born on 26-09-1972.

During the course of hearing, we had enquired with the learned advocate Mr. Adwant for the respondents as to if even though already petitioner's representation has been considered and decided, the respondents would re-visit the issue particularly in view of the extract of the original birth and death register, a copy of which is

2 WP / 13493 / 2018 received by the petitioner from the Aurangabad Municipal Corporation pursuant to his application under the Right to Information Act and which copy is produced on the record (Page 116), which prima facie substantiates petitioner's claim.

On instructions, Mr. Adwant makes a statement that the respondents would reconsider the petitioner's request on its own merits and in accordance with the regulation by taking into account such record regarding date of birth available with the Aurangabad Municipal Corporation.

We dispose of the petition by directing the respondents to reconsider the petitioner's request on its own merits and in the light of the above observations as expeditiously as possible and in any event within six months, obviously by extending an opportunity to the petitioner of being heard.
