Heard the learned counsel for the applicant and the learned A.P.P. for the respondent.

The applicant seeks bail in C.R.No.53 of 2024 registered with Bazarpeth Police Station, Bhusawal, District Jalgaon, for the offences punishable under Section 370 of the Indian Penal Code and Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956.

The prosecution has a case that the applicant and his wife were engaged in immoral trafficking. They were providing a place for illegal sex for woman and charging the commission. On a secret information, the raid was conducted. A few women were found there. They agreed to do the sex on consideration. The

10-BA-1552-24.odt applicant was the owner of the house, wherein his wife was running a spa. The statements of the women engaged in this business were also recorded. In the statements, they stated that they were voluntarily doing such a profession for their livelihood. It was alleged against the applicant that he was collecting the commission.

Though the learned A.P.P. opposed bail application on the ground that this is an immoral act of the applicant, the Court is of the view that nothing is to be recovered from the applicant. The applicant is in jail for sufficient time. The trial may take its time. No weapon has been used in the crime. Therefore he deserves bail. Hence, the order:-

ORDER

i) The bail application is allowed.

ii) Applicant - Vishal Shantaram Barhate be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should not involve in such identical crime. (c) He should attend the trial on each date.
