PER COURT:- 1.

It is contended by the learned counsel for the petitioner that the tribe claim of the petitioner is pending with respondent no.2Committee since the year 2013. The same is not yet decided.

The respondent-employer is not sanctioning the retiral benefits.

Considering the fact that the petitioner has retired, we pass the following order:

ORDER

(i) The petitioner shall appear before respondent no.2-Committee on 03.09.2019.

(2) 923-wp-10331-2019 (ii)The Committee shall decide the validation proceeding in respect of the tribe claim of the petitioner within a period of three months from the date of appearance of the petitioner. In the interregnum there would be no impediment for the employer to pay gratuity and provident fund amount to the petitioner.

Writ Petition is disposed of. No costs.
