The petitioner's claim of belonging to 'Thakur' - Scheduled Tribe is pending adjudication since 24/05/2012. By the impugned order dated 18/06/2021, he has been placed on supernumerary post w.e.f. 31/12/2019, for a period of 11 months. The learned Advocate for the petitioner submits that the petitioner is continued as such even today. Due to continued extension orders on the supernumerary post, he is in service.

The Advocate for the petitioner further submits that, the petitioner has recently received the Vigilance Cell Enquiry Report. He has appeared on 11/11/2022 before the Amravati

10435.22wp (2) Committee. Written submissions have been tendered and the file has been closed for judgment.

In view of the above, since the petitioner is continued in employment and since his salary is protected, this petition is disposed off. We expect the Committee to deliver it's judgment on the claim of the petitioner, as expeditiously as possible and in any case, on or before 31/01/2023.
