Sunny Dilip Jaiswal v. Dipti Sunny Jaiswal
2025:BHC-AUG:22993
IN THE JUDICATURE OF HIGH COURT AT BOMBAY
BENCH AT AURANGABAD 925 WRIT PETITION NO. 10422 OF 2025 Sunny Dilip Jaiswal
VERSUS
Dipti Sunny Jaiswal ...
Advocate for the Petitioner : Mr. Bhimrao Ganpat Lathe ...
CORAM : ARUN R. PEDNEKER, J.
Dated : August 22, 2025.
PER COURT :- 1.
Heard the learned Counsel for the petitioner. 2.
The learned Counsel submits that in the year 2020, the petitioner had filed a petition for restitution of conjugal rights under Section 9 of the Hindu Marriage Act. Thereafter, in the year 2021, the respondent-wife filed a petition under the Domestic Violence Act, and subsequently, in the year 2024, she filed a petition for divorce.
3.
In the petition filed by the husband for restitution of conjugal rights, the respondent-wife filed an application dated 11/03/2025 seeking interim maintenance for herself and their minor child, aged six years. The said application was allowed by the learned Civil Judge, Senior Division, Jalna, by granting interim maintenance of Rs.15,000/- per month for both the applicants, i.e., the respondent-wife and the minor son, with effect from 11/03/2025. The Court further granted Rs.30,000/- towards litigation expenses and Rs.15,000/- towards travelling expenses. 4.
Considering that the petitioner is employed as a Marketing Manager at Page 1 of
925 WP 10422-2025 Thane, the amount of Rs.15,000/- awarded as interim maintenance for the respondent-wife and the minor child cannot be said to be excessive. 5.
In view of the above, there is no reason to interfere with the order passed by the learned Civil Judge, Senior Division, Jalna. 6.
Accordingly, the petition stands dismissed.
