DATE :- 19th August, 2023 Per Court :- (a) Family Court Appeal No.68/2023:- 1.

The Appellant is the husband, who has suffered the impugned judgment dated 29.05.2023 by which, Appeal No.A206/2022 filed by the Respondent/ wife seeking divorce, has been allowed.

The couple has a child, who is more than one year old.

Issue notice to the Respondent. Shri Kulkarni, the learned Advocate, waives service of notice on caveat.

The learned Advocates for the respective sides are amenable to mediation proceedings. They suggest the name of Smt.S.T. Kazi, learned Advocate.

Office to transmit the papers to the learned Mediator.

The learned Advocates are at liberty to contact the learned Mediator for early initiation of the mediation proceedings.

7.

Liberty to the parties to circulate the appeal after the mediation is concluded.

(b) Civil Application No.10389/2023:- 8.

Issue notice to the Respondent. Shri Kulkarni, the learned Advocate, waives service of notice on caveat. 9.

In the light of the submissions of the learned Advocates and for the reasons set out, the Civil Application is partly allowed and both the litigants are directed not to enter into a second marriage with anybody else until further orders in the appeal.
