Heard learned counsel for the applicant as well as the learned counsel for the respondent- Insurance company.

This is an application for withdrawal of the amount of compensation deposited in this Court to the tune of Rs.5,89,356/-. The learned counsel for the respondent insurance company opposed the application on the ground that the insurance company has presented the appeal on the ground of quantum. The learned counsel submits that the deceased was aged about 12 years and in any case, the amount of compensation will not go beyond Rs. three lakhs.

In view of the above, the applicants can be allowed to withdraw an amount of Rs.3,00,000/- (three 1/2
934.odt lakhs) out of the total amount deposited in this Court and accordingly they are allowed.

Civil application is disposed of.
