PER COURT :- 1) Learned Counsel for the applicant submitted that the summons could not be served on Respondent No.1 and the remark is received that "Respondent No.1 is not residing on the given address". The learned Counsel submits that the address on which summons were issued is the only known address of Respondent No.1 and the same is existing in the record of the court below. The learned Counsel has, therefore, prayed for service on Respondent No.1 though paper publication.

2) In view of the submission so made, the civil application is allowed and disposed of. The BDV
