Present application has been filed under Section 482 of the Code of Criminal Procedure for quashment of the proceedings in

R.C.C. No.395 of 2020, pending before the learned Judicial Magistrate First Class, Sakri, Taluka Sakri, District Dhule, arising out of FIR vide C.R. No.27 of 2019 dated 2nd February, 2019, registered with Sakri Police Station, Taluka Sakri, District Dhule, for the offence punishable under Sections 354, 504 and 506 read with 34 of the Indian Penal Code.

By our order dated 7th February, 2025, the parties were directed to appear before the learned Registrar (Judicial) of this Court. The parties were present before the learned Register (Judicial). The learned Registrar (Judicial) has verified the compromise pursis and submitted the report.

It appears that the learned Advocate for the applicants and respondent No.2 have filed on record duly signed compromise pursis in between applicants and respondent No.2. Alongwith the said terms of compromise, the applicants have produced self attested photocopies of their Aadhar cards. The learned Register (Judicial) has verified them on the basis of their original Aadhar cards produced by them for identification. Respondent No.2 is identified by her original Aadhar card produced by her. The learned Register (Judicial) has read over the contents in the compromise pursis to the parties. They admit the contents and their signatures on it. They submitted that they

have voluntarily entered into the compromise and no force or fraud is played upon them.

In view of the above, we have no hesitation in exercising our powers under Section 482 of the Cr.P.C. for quashing the proceedings. Hence, the following order is passed:-

O R D E R

I.

The application stands allowed.

II.

The proceedings in R.C.C. No.395 of 2020, pending before the learned Judicial Magistrate First Class, Sakri, Taluka Sakri, District Dhule, arising out of FIR vide C.R. No.27 of 2019 dated 2nd February, 2019, registered with Sakri Police Station, Taluka Sakri, District Dhule, for the offence punishable under Sections 354, 504 and 506 read with 34 of the Indian Penal Code, stands quashed and set aside as against all the applicants.
