These applications are for withdrawal of amount deposited by the respondent-Corporation. The proceedings are emanating from the self-same accident. The claimants are riders of a motor cycle, who were given dash by bus owned by the respondent-Corporation.

The learned counsel for the respondent-Corporation would submit that considering the evidence on record, the theory of accident is 1/2
964 966 CA 9171 25+.odt improbable. He would submit that age of one of the claimants is seriously disputed. He would further submit that reliance on Aadhar Card for the purpose of age determination is vulnerable.

I have considered the rival submissions of the parties. Both are the injury claims. The motor cycle involved in the accident has been damaged. Ends of justice would be made in permitting the applicants to receive 75% of the compensation deposited in this Court.

The Civil Applications are partly allowed, permitting the applicants to receive 50% of the amount with accrued interest on furnishing undertaking and further 25% of the amount on furnish solvent surety to the satisfaction of the Registrar (Judicial) of this Court. Balance amount shall be invested in any nationalized bank.
