At the outset, when this Court has shown its disinclination to grant any relief to Applicant No. 1, learned Counsel for Applicant, on instructions, seeks withdrawal of application at the extent of this Applicant.

Application stands dismissed as withdrawn qua Applicant No. 1.

As far as Applicant No. 2 - Limbaji is concerned, learned Counsel for the Applicant submits that there are no allegations against him of causing any grievous injury to husband of informant. She states that there are no criminal antecedents against this

30-ABA-1368-2023.odt Applicant. She further states that in respect of said incident, report was lodged by sister-in-law of Applicant No. 2.

Learned APP opposed the application.

Perusal of FIR shows that allegations against present Applicant is of causing assault but the investigation papers do not show any grievous injury to be attributable to the present Applicant No. 2. He has no criminal history and is not likely to flee from justice.

Having regard to these facts, liberty of the Applicant No. 2 is protected. Hence, application is allowed by confirming interim order dated 22nd August, 2023.
