The respondent - informant suomoto appears through his advocate Mr.Ajay P. Deshmukh. He files affidavit giving express consent to allow the present application. The said affidavit was sworn in before the Jailer in jail in which the informant has been lodged in connection with some other crime.

The applicant is Medical practitioner. Allegations in the FIR are that the applicant while attending the informant professionally gave cut on his stomach with sharp edged bled. There is delay of one month in lodging of the FIR.

Since the informant himself gives express consent to allow this application and there is delay of one month in lodging the FIR, we allow the application in terms of prayer clause "B", subject to
