1] learned counsel for the applicant states that respondent No.2 cannot be served by ordinary process of the Court and even at the stage of condonation of delay, he was served by issuing notice in daily newspaper. Hence, the application is allowed and the applicant is permitted to serve the respondent No.2 by public notice in the daily newspaper "Hindi Milap" published from Hyderabad. In this view of the matter order of dismissal of the appeal as against respondent No.2 is set aside. Application is disposed of.
