1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No.0789/2024, registered at Shrirampur City Police Station, District Ahmednagar, for the offences punishable under Sections 64, 74, 115(2), 352, 3 (5) of the Bhartiya Nyaya Sanhita, 2023.
3] This court by order dated 28.08.2024 has granted interim protection to the applicant. In pursuance of the order of this court the applicant has cooperated with the investigation. The charge-sheet is filed in the matter. The applicant appeared in the matter and he has been already granted bail by the court.
4] The case against the applicant is that when the informant had gone for medical checkup to the Doctor the applicant has inappropriately touched the informant. As such, the offence under the above sections is registered against the applicant.
5] The learned counsel for the applicant submits that when the applicant visited for medical checkup, the other lady members and also the warden was present at the time of the examination of the victim. So also, he submits that the applicant has 40 years of practice as a Doctor and he is a reputed Doctor. The learned counsel also submits that there were other organizations involved in the same, on whose behest this complaint is filed.
6] Considering that after the grant of interim protection the applicant has cooperated with the investigation and there is no grievance regarding the same by the prosecution, and also considering the nature of allegations, the interim protection granted to the applicant by order dated 28.08.2024 stands confirmed, on the following terms:
i] The applicant shall attend the police station as and when required by the Investigating Officer. ii] The applicant shall not tamper with the
evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.
iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.
7] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.
8] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
9] The application stands disposed of.
