The learned Advocate for the respondents has fairly accepted that the impugned order passed at Exhibit 11, dated 01/02/2019, in Regular Civil appeal No.178/2015, by the District Judge-3, Ahmednagar, is cryptic order without reasons.

In view of the same, the order passed at Exhibit 11, dated 01/02/2019, in Regular Civil appeal No.178/2015, by the District Judge-3, Ahmednagar is set aside, and the matter is remitted back to the Trial Court to pass appropriate order at Exhibit 11 after hearing the parties and after considering relevant provisions of law.
