The learned Counsel for the petitioner submits that the petitioner is seeking stepping up the pay scale. Only because the petitioner had Ph.D qualification prior to 01.01.2006 and one Dr. Sharad Agrawal was awarded Ph.D after 01.01.2006, the said Dr. Sharad Agrawal is given additional increment. According to the petitioner, junior cannot be paid more than the senior. The learned Counsel for the petitioner submits that he would file an application with the Joint Director of Higher Education with regard to his pay scale.

The learned Assistant Government Pleader accepts notice for both the respondents.

In case the petitioner files an application with the respondent No. 2 for stepping up his pay scale to that of his junior as contended by him, then the Joint Director of Higher Education, Jalgaon shall decide the said application of the petitioner preferably within a period of four months from the date of application of the petitioner on its own merits and according to law. 4.
The Writ Petition is disposed of. No costs.
