Mr. Maniyar, the learned counsel for the petitioner states that the petitioner was earlier employed with Private Grant in Aid School. He was declared surplus. The petitioner was temporarily absorbed with Zilla Parishad School, Biloli. Thereafter, order is issued for absorbing the petitioner in another Zilla Parishad School i.e. Hadgaon. Learned counsel submits that Zilla Parishad, Nanded has also forwarded the proposal to the Government seeking permanent absorption of persons like the petitioner in zilla Parishad School. Said proposal is still pending. According to the learned counsel, work is available at Zilla Parishad, Biloli. There was no reason to make correction in the said order. Petitioner be allowed to work in the Zilla Parishad, School Biloli. 2.

Learned counsel appearing for Zilla Parishad submits that as per rules the permission is required to be obtained of the State Government to fill in the posts in the establishment of the Zilla Parishad. Proposal is already forwarded on 27.1.2014 to the

WP 9014.2014.odt Government. Government has directed the Zilla Parishad to take appropriate decision in this regard. Said decision would be taken. 3.

It appears that, even the Zilla Parishad had communicated with the Government to allow the Zilla Parishad to absorb the surplus teachers like the petitioner permanently in the Zilla Parishad School.

In light of that, we pass following order.

ORDER

The petitioner shall be continued at Zilla Parishad, School Biloli i.e. the Place where petitioner is working today till the final decision is taken for absorption of the petitioner in Zilla Parishad School or otherwise as is stated in paragraph No.5 of the affidavit-in-reply filed by respondents No.2 and 3.

Writ Petition accordingly disposed of with aforesaid observations and directions. No costs.
