IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.387 OF 2019 NARESH UTTAM BACHHAV PATIL

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS Mr.V.S. Panpatte, Advocate for the petitioner. Ms.R.P. Gaur, AGP for the respondent/State.

CORAM :

PRASANNA B. VARALE & S.M.GAVHANE,JJ.

DATED :

15.01.2019 P.C. :- 1.

Heard learned Counsel for the petitioner. As the grievance raised in the petition is of limited nature, the petition is taken up for disposal at the admission stage. 2.

The father of the petitioner Shri Uttam Sonu Patil was an employee of respondent No.3 - Society. The father of the petitioner expired on 05.02.2001 (though at Exh. "A" - death certificate is placed on record, by typographical error date is shown as 05.02.2009 instead of 05.02.2001). The petitioner submitted an application to respondent No.5 seeking employment in place of his father on compassionate ground. Copy of appointment order is placed on record and the same shows that the petitioner was appointed on

( 2 ) wp387.19 01.06.2005. Copy of joining report also placed on record at Exh."C". The Education Officer (Secondary) informed respondent No.4 - Head Master by way of communication dated 24.08.2005 to submit the modified staff approval. It seems that respondent No. 4- Head Master submitted proposal for approval to the appointment of the petitioner on the post of Peon on 12.09.2016. Learned Counsel submitted that this proposal is pending before the Education Officer till date and the Education Officer be directed to decide the proposal expeditiously.

3.

This being limited grievance, the petition is disposed of with direction to the Education Officer (Secondary), Zilla Parishad, Dhule i.e. respondent No.2 to decide the proposal dated 12.09.2016 as expeditiously as possible, needless to state on merits of the proposal. 4.

With these directions, the writ petition is disposed of.
