We have heard Mr. Temak, learned counsel for petitioner. The learned counsel submits that twice the proceedings filed by the predecessor of the present respondents were dismissed in default. Again notice of hearing has been issued. The respondent Nos.4 and 5 by suppressing the fact of dismissal of petitions twice, had filed Writ Petition No.4163 of 2021 and sought directions to decide the proceedings expeditiously.

The petitioner has been given notice of hearing. The petitioner can raise all the issues and grounds of defence including the grounds of dismissal of petitions earlier and the authority of the Tahsildar. All the grounds raised by the parties, certainly will have to be considered by the Tahsildar.
