This is an application for grant of bail under section 439 of the Code of Criminal Procedure, in connection with C.R. No.I-153 of 2015, registered with Sangamner (City) Police Station, for offences punishable under sections 307, 323, 143, 147, 148, 149 of the Indian Penal Code and under section 37 (1) (3) and 135 of the Bombay Police Act. 2.

The applicants were arrested on 8th July, 2015 and were in police custody remand till 10th July, 2015.

Though the applicants are named in the first information report, yet from the record it appears that at the behest of the group of the present applicants, C.R. No.155 of 2015 is already registered against the group of the complainant.

Apart from above, looking to the age of the present applicants and the nature of evidence that is available, in my opinion, it will be appropriate to order their release on bail. I, therefore, pass following order :-

criap4926.15 (2) The applicants be released on bail, in connection with C.R. No.I-153 of 2015, registered with Sangamner (City) Police Station, for offences punishable under sections 307, 323, 143, 147, 148, 149 of the Indian Penal Code and under section 37 (1) (3) and 135 of the Bombay Police Act, on each of them furnishing P.R. Bond of Rs.10,000/- with one surety in the like amount. The applicants shall not enter the jurisdiction of the concerned police station till filing of the charge-sheet. Criminal Application stands allowed in above terms. (N.W. SAMBRE, J.) amj
