Mr. Tribhuvan, the learned counsel submits that, father of the petitioner had died on 26.06.2003. At the time of death of the father of the petitioner, the father of the petitioner was drawing salary in the pay scale of Rs. 5500-9000/- and not in the pay scale of Rs. 6500-10500/-. The learned counsel submits that, the effect of increased salary was given in the year 2004, as such on the date when the father of the petitioner died, his salary was such that he would come in Group - C and as such would be entitled to claim appointment on compassionate ground.

We have read the order dated 26.11.2014 passed in the writ

2 ra st 26508.15 petition. Though the father of the petitioner at the time of his death was drawing less salary, however, in the year 2004 the salary was increased. The same was given retrospective effect from the year 1996. As such, it will have to be held that, the father of the petitioner since 1996 was drawing the salary in Group - B category. The same was considered while disposing of the writ petition. 3.
