...
CORAM: SMT. VIBHA KANKANWADI AND S.G. CHAPALGAONKAR, JJ.
DATE : 3rd MAY, 2024 ORDER :
1.
Heard learned Advocate Mr. Khot for the applicant, learned AGP Mr. K.S. Patil for respondent Nos. 1 and 2 and learned Advocate Mr. Bolkar for respondent No.3. Learned Advocate for respondent Nos. 4 and 5 is absent. It appears that the present applicant intends to file review petition, however, there were office objections. Ultimately conditional order came to be passed by the learned Registrar (Judicial) for removal of the office objections. Still it appears that the office objections were not
ca-1217.23 removed and therefore the review application was not registered. Now there is delay of 172 days in filing present application.
2.
Learned Advocate for the applicant is taking it upon himself that he could not notice the conditional order passed by the learned Registrar (Judicial). He is showing willingness to remove the office objections.
3.
Taking into consideration this fact, the Application stands allowed. Delay stands condoned. The office objections in respect of review application be removed within a period of seven days. 4.
Applicant to deposit cost of Rs.1000/- to the Library of the Advocate's Association of Bombay High Court, Bench at Aurangabad, within seven days. After removal of office objections, the learned Advocate for the applicant is at liberty to take further circulation.
