Heard both sides.

The record shows that the applicant has now furnished bail in the trial Court in response to the bailable warrant issued by this Court earlier vide order dated 03/07/2015.

In the circumstances, upon furnishing fresh P.R. bond and surety in the amount of Rs.50,000/-, in order to bind himself to regularly appear in the present Criminal Appeal, as per the provisions of section 390 of the Code of Criminal Procedure, the order dated

Appln. 4928/2015 03/09/2015 passed in Criminal Application no.437 of 2014 of issuing non-bailable warrant against the present applicant, is hereby recalled, on further condition that the applicant deposits an amount of Rs.10,000/- (Rs. Ten Thousand) in this Court, towards the costs payable to the applicant in Criminal Application no. 436 of 2014 - Ajantha Urban Co-operative Bank Ltd., within a period of four (4) weeks from today.

The learned Judicial Magistrate First Class, Aurangabad to take action under section 390 of the Code of Criminal Procedure as directed above.

The applicant undertakes to appear before the learned Judicial Magistrate First Class, Aurangabad on 30/09/2015 with hamdast of the present order. 6.
Hamdast granted.

Application is accordingly allowed and disposed of.
