Criminal Application No.3210/2025 is not on board. By consent of the parties the same is taken on board.

In all these matters, the applicants are praying for transfer of proceedings bearing R.C.C. No.74/2022, proceedings bearing Criminal Misc. Application No.02/2023 and proceedings bearing Criminal Misc. Application No.261/2019, respectively, from the Court of Judicial Magistrate First Class, Ashti, Dist. Beed to the Court of Judicial Magistrate First Class, Chandrapur.

Learned Advocate for the applicants states that the aforesaid proceedings are pending with the Judicial Magistrate, Ashti, Dist. Beed and the same may be transferred to Chandrapur as it is inconvenient to them to attend the proceedings at Ashti, Beed due to old age and threats and terror of respondents. 4.

Learned Advocate for respondent states that witnesses are staying at Ashti and as such, there will be inconvenience to them to attend the proceedings at Chandrapur.

In view of the above, both the learned Advocates suggested that all these matters may be transferred to Judicial Magistrate at Aurangabad for convenience of all the parties and the witnesses. Learned Advocate for the applicants states that the applicants shall bear the expenses of the witnesses as regards travelling them to Aurangabad.

Having heard both the sides and after perusing the record, I am of the opinion that it would be convenient to all the parties and witnesses to attend the proceedings at Aurangabad. Hence, all these proceedings bearing R.C.C. No.74/2022, Criminal Misc. Application No.02/2023 and Criminal Misc. Application No.261/2019 be transferred from the Court of Judicial Magistrate First Class, Ashti, Dist. Beed to the Court of Judicial Magistrate First Class, Aurangabad. Needless to state, the applicants shall bear the expenses of witnesses for travelling them to Aurangabad on their attending/evidence dates. 7.

All the applications are disposed of in view of above terms.
