The learned counsel appearing for the applicant / plaintiff submits that he has moved an application before the civil court to bring the legal heirs of the sole plaintiff on record. However, the same is not proceeded by the learned trial court in view of the stay granted by this court to the proceedings.

Having considered the submissions of the parties, the application to bring the legal heirs of the sole plaintiff i.e. Exhibit 1261 be decided by the learned trial court, to that extent the order of the stay of the proceedings would stand modified.
