After arguing for some time, learned advocate for the petitioner, on instructions, resiles to a situation, wherein the petitioner may be granted liberty to make a proper application for deletion of issue No.2, as originally framed by the court, to be decided on merits.

Under the circumstances, writ petition is not being prosecuted for the purpose for which it has been filed. 4.

As such, writ petition stands disposed of with aforesaid liberty.
