Heard. Perused the impugned award.

This application has been moved by father of the appellant for withdrawal of the amount of compensation awarded towards acquisition of his land. The son of the applicant claims to have share in the land. The amount in deposit is little over Rs.9 lakhs. The applicant is said to be eighty five plus.

In the fitness of things, the applicant is permitted to withdraw 50% of the amount in deposit as against undertaking to be submitted to the 1 / 2

933-CA-11631-21.odt satisfaction of the reference Court. The amount shall be disbursed within couple of days. If the appeal is not decided within a time frame of one year, the applicant may move an application for further withdrawal. Civil application stands disposed of.
