Heard the learned counsel for the applicant, the learned A.P.P. for the respondent/State and the learned counsel for the victim.

The applicant seeks bail in C.R.No.167 of 2024 registered with M.I.D.C. Waluj Police Station, Aurangabad, for the offences punishable under Sections 302, 304B read with Section 34 of the Indian Penal Code.

It is a case of murder of the wife of the brother of the applicant. The deceased was found lying in a room which was

915-BA-1499-24.odt locked from outside. The relatives of the deceased reached there. They broken the glass of the window and found that the deceased was lying unconscious. The husband of the deceased went to the police station. He brought to the police. They opened the lock and it was found that deceased was strangulated. The allegations against the applicant were that he was demanding dowry. He has a case that he has no concern with the deceased. No weapon is recovered from him.

Considering the nature of the incident and the allegations levelled against the applicant, the Court is of the view that the applicant deserves bail. Hence, the order:-

ORDER

i) The application is allowed.

ii) Applicant - Rameshwar Babusingh Bedval be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should attend the trial on each and every date. iii) Criminal Application No.3713 of 2024 stands disposed of. ( S. G. MEHARE ) JUDGE rrd
