Applicants seek to condone the delay, set aside abatement and bring heirs of applicant No. 2 - Badri Saindas Chavan on record.

The cause of action survives against heirs of the applicant No. 2. They are necessary parties. Such type of application should have been filed by the acquiring body. The civil application is allowed in terms of prayer clauses 'B' 'C' and 'C-1'. The civil application is disposed of.
