The learned Advocate for the Petitioner submits, on instructions, that the Petitioner desires to file a suit for partition and separate possession of the ancestral property. He, therefore, seeks liberty to withdraw this petition so as to prefer a separate suit. The learned Advocate for Respondent Nos.1 and 2 submits that if such a fresh suit is instituted, the contentions and rights of these Respondents be kept open for the concerned Court to consider them on their merits.

In view of the above, this Writ Petition is disposed of as withdrawn.
