Vide Registrar's order dated 4/8/2009, the appeal has been dismissed against respondent No.1 for want of taking steps. There is delay of 4415 days in preferring this application for setting aside Registrar's order. For the reasons given in the application, the same is allowed in terms of prayer clauses (B) and (C).

Notice be issued to respondent No.1 in appeal, returnable on 11th January 2022. In addition to usual mode of service, the appellants are permitted to serve the respondent No.1 privately by any other permissible mode of service and shall file affidavit to that effect.
