The petitioner has been placed on supernumerary post for a period of 11 months or till the date of retirement, whichever is earlier, vide order dated 15.06.2022 on account of the non submission of the caste validity certificate. The petitioner's claim is pending since 01.08.2013 before the competent committee at Dhule.

It is stated that the vigilance cell enquiry report dated 30.04.2014 was served on the petitioner vide notice dated 16.09.2014 to which, the petitioner has replied on 03.10.2014. 3.

In view of the above, this Writ Petition is disposed

The petitioner would appear before the competent committee at Dhule on 01.12.2022 at 12:00 noon. The written submissions can be tendered by the petitioner to the committee in the form of written arguments. The said committee shall deliver it's order on or before 31.01.2023. The copy of the order shall be kept ready to be delivered to the petitioner forthwith, upon pronouncement.

Needless to state, since the service of the petitioner is protected until 15.05.2023 and his salary remains unchanged, respondent No.3 would not dispense with the service of the petitioner for a period of 30 days pursuant to the order passed by the committee, in the event of his claim being invalidated. kps (SANJAY A.
