Application seeks to condone the delay, set aside abatement and bring legal heirs of the deceased respondent No. 4 - Dadarabo Pandurang Pawar on record. The cause of action survives against the legal heirs.

For the reasons stated in the application it is desirable to condone the delay. The civil application is allowed in terms of prayer clauses 'B' and 'C'. The civil application is disposed of. 3.
