These applications arise out of first information report bearing No.0279/2023, registered with Osmanabad City Police Station, Dist. Osmanabad, for the offences punishable under Sections 420, 409, 406 read with Section 34 of the Indian Penal Code and under Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors Act, 1999.

All applicants are the Directors of the Vasantdada Nagari Sahakari Bank Ltd, Osmanabad.

Learned counsel for applicants have drawn attention of this Court to the various orders passed by the Hon'ble Supreme Court, granting anticipatory bail applications to the other Directors of the said Bank. Pertinently, the Directors, whose anticipatory bail applications came to be rejected by this Court,
(3) also have been granted anticipatory bail by the Hon'ble Supreme Court.

Having regard to this fact, and since role of present applicants cannot be distinguished from accused, who are granted anticipatory bail by the Hon'ble Supreme Court, there is no reason of justification to reject these applications. Solely for the reason that, similar accused have been granted anticipatory bail by the Hon'ble Supreme Court, all these applications are allowed. Hence, the following order :-
ORDER
(i) In the event of arrest of applicants in connection with Crime No. No.0279/2023, registered with Osmanabad City Police Station, Dist. Osmanabad, for the offences punishable under Sections 420, 409, 406 read with Section 34 of the Indian Penal Code and under Sections 3 and 4 of the Maharashtra Protection of Interest of Depositors Act, 1999, they be released on bail on furnishing PR Bond of Rs. 15,000/- (Rs. Fifteen Thousand only) each with one surety in the like amount.
(4) (ii) They shall attend the concerned police station once in a week.
(iii) They shall not contact the witnesses directly or indirectly.
(iv) They shall not interfere with the evidence in any manner whatsoever.
(v) They are further directed to cooperate the investigating agency for further investigation. (vi) Learned APP to communicate this order to the concerned Investigating Officer.
