This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 413 of 2022 registered with Shirpur Police Station, Dist. Dhule for the offences punishable under Sections 307, 395, 385, 143, 144, 147, 148, 149, 323, 324, 504 and 506 of the Indian Penal Code. 2.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

Similarly placed co-accused has been granted bail by this Court vide order dated 14th September, 2022. Although the learned A.P.P. has 1 / 2

952-BA-1565-22.odt reservation to grant the application, this Court has no option but to grant bail to the present applicant in view of similarly placed co-accused has been granted bail.

In view of above, the application deserves to be allowed. Hence I pass the following order :-

ORDER

(I) The bail application is allowed.

(II) The applicant be released on bail, in connection with Crime No. 413 of 2022 registered with Shirpur Police Station, Dist. Dhule for the offences punishable under Sections 307, 395, 385, 143, 144, 147, 148, 149, 323, 324, 504 and 506 of the Indian Penal Code, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount.

(III) The applicant shall attend Shirpur Police Station, Dist. Dhule everyday between 07:00 p.m. and 08:00 p.m. for a period of two months and thereafter on every Monday between 07:00 p.m. and 08:00 p.m. for next six months.

(IV) The applicant shall not tamper with the prosecution evidence.
