These matters are the counter complaints. Criminal Application No.3746 of 2024 has been filed for quashing FIR vide C. R. No.196 of 2024 and Criminal Application No.3756 of 2024 is filed for quashing FIR vide C.R. No.195 of 2024. Both the FIR's are registered at Chikalthana Police Station, Taluka and District Aurangabad and both are under Sections 354, 452, 323, 504, 506 read with Section 34 of
-2the Indian Penal Code, 1860.

The parties have arrived at the settlement. Accordingly, the terms of settlement and affidavit have been produced on record. The victim, i.e. injured had also settled the matter. It is stated that with the intervention of the neighbours the compromise has taken place. 3.
Though, it appears that the affidavits are signed by four persons, only two persons are the applicants before us in Criminal Application No.3746 of 2024. The terms of settlement have been got verified through learned Registrar (Judicial) who has submitted his report on 22.10.2024. In view of the settlement between the neighbors and as they want to keep good relationship, there is no hurdle in exercising power under Section 482 of Cr.P.C. However, since both of them have utilized the machinery, we impose costs. We, therefore, proceed to pass following order:-
O R D E R
(i) Both the Criminal Applications stand allowed. (ii) FIR vide C.R. No. 195 of 2024 and C.R. No.196 of 2024 registered with Chikalthana Police Station, Taluka and District Aurangabad for the offence punishable under Sections 354, 452, 323, 504, 506 read with Section 34 of
-3the Indian Penal Code, 1860 stand quashed and set aside as against applicants Namely (1) Anil Pramod Raut (2) Swati Anil Raut (3) Ashok Rangnath Khandagale and (4) Sujata Bappasaheb Patange.
(iii) The applicants from both the applications to deposit cost of Rs.5000/- each, with the High Court Legal Services SUB Committee, Aurangabad on or before 14.02.2025. We make it clear that if they failed to deposit such costs then both the FIR's would get revived.
