Mr. Pawan Tele, Assistant Manager of the appellant is present with the Advocate for the appellant. Mr. C.R. Deshpande, the learned Counsel for respondent nos. 1 to 5 is present. 2.

The learned Counsel for the appellant submits that the appellant wish to withdraw the appeal. He submits that 50% of the amount of compensation has already been deposited in the Court, remaining 50% will be deposited within six weeks from today. 3.

Respondent Nos. 3, 4 and 5 were minors at the time of filing claim petition before the Motor Accident Claims Tribunal, Dhule on 23.3.2010. Now, all of them have become major. The learned Counsel for the respondents has no objection for withdrawal of the appeal.

The amount of compensation will have to be apportioned amongst respondent nos. 1 to 5, who are, widow, mother, son,

-2daughter and son respectively of the deceased Ankush. Considering their ages and future requirements, the amount of compensation will have to be ordered to be apportioned equally amongst them. 5.

The appeal is allowed to be withdrawn. It is accordingly disposed of.

Court fee be refunded to the appellant as permissible under the rules.

No costs.
