Mr. Hon, the learned senior advocate on instructions of the petitioner submits that, in view of the affidavit filed by the respondent No. 1, the petitioner is withdrawing the writ petition and he would prosecute his right before the appropriate authority.

Mr. Manorkar, the learned counsel submits that, in the affidavit filed by the respondent No. 1 there is no clear admission about the area of the petitioner. The affidavit states that, it
