The application for appointment of the Court Commissioner is rejected; as it would amount to collection of evidence on behalf of the plaintiff. The evidence of the plaintiff is yet to be recorded. 3.

I see no reason to interfere in the impugned order, however, liberty is granted to the petitioner to move an application for appointment of the Court Commissioner; after the evidence of the parties is over. The court may consider such an application in accordance with law, if, further evidence is required in terms of appointment of the Court Commissioner.

With the above observations, the writ petition stands disposed of.
