Petitioner is challenging order dated 11.07.2025 passed by Sub Divisional Magistrate under Section 56(1) of the Maharashtra Police Act, externing him for one year from District Jalgaon.

Learned APP points out that there is alternate efficacious remedy by filing appeal under Section 60 of the Act before the Commissioner.

As there is efficacious statutory remedy under Section 60 is available, the present writ petition cannot be entertained.

Learned counsel for the petitioner seeks leave to withdraw this writ petition for availing the alternate remedy. Writ petition is permitted to be withdrawn.

Writ petition is disposed of with a liberty to approach Appellate Authority.

The delay caused in prosecuting present writ petition shall be considered by the Lower Appellate Authority for condonation of delay. This Court has not expressed any opinion on the merits of the matter.
