Heard from advocate for appellants. It is office objection that there is difference in the name of appellant and the death certificate as produced on record. The learned advocate submitted that appellant Vaijanath Mahada Mali was also known as Vaijanath Mahada Lokhande. According to him, Vaijanath Mahada Mali and Vaijanath Mahada Lokhande are one and same person. I find the arguments as advanced by the advocate are quite convincing and believable. Therefore, believing the death certificate placed on record, I am of the view that it is of Vaijanath Mahada Mali. So also, considering this application is moved within limitation, I find applicants deserve to be permitted to appear in Second Appeal as L.Rs. of original appellant Vaijanath Mahada Mali. C.A.
