Heard the learned counsel for the applicant, the learned A.P.P. for the State and the learned counsel for the informant. 2.

The applicant seeks bail in C.R.No.427 of 2024 registered with MIDC Cidco Police Station, Aurangabad, for the offences punishable under Sections 80(2), 85, 115(2), 352, 3(5) of the Bhartiya Nyaya Sanhita, 2023.

It is an unfortunate incident that a newly married woman ended her life by suicide within four months from her marriage. In

most of the cases, the allegations of demand of dowry are made. After suicide. In the present case, the allegations of demand of dowry have been levelled against that the applicant had extra marital relationship with another woman. The first information report reveals that the deceased personally verified the fact that the applicant was talking another woman who is also the coaccused. 5.

The applicant has a case that he never demanded for dowry. However, since the deceased committed suicide suddenly, the allegations of demand of dowry have been levelled against him. The deceased had some suspicion about the applicant having extra marital relationship. However, there was no relationship, as such except an acquaintance and talking on the phone with her. No weapon has been used in the crime. The applicant is in jail from 08.08.2024. The material investigation has been completed. Hence, he may be granted bail.

The learned A.P.P. and the learned counsel for the victim have vehemently opposed the application. They submit that the offence is serious. Within a short span of four months, a young girl lost her life due to extra marital relationship and demand of dowry. 7.

The learned counsel for the victim has argued that this is not a simple suicide. It is a sort of murder. The investigation is in progress. The applicant may tamper with the prosecution

witnesses. Hence, he may not be granted bail. 8.

Considering the facts as discussed above, an unfortunate incident happened within four months from the marriage. The report was lodged first time after suicide. It also appears from the record that the deceased had also seen the applicant talking to another girl who is co-accused in the matter. Considering the allegations, the Court is of the view that the custodial interrogation in the matter is not essential. The applicant is also young boy having no antecedents to his discredit. The Court does not find any reason to detain the applicant for the purpose of the investigation. Hence, the order:-

ORDER

i) The bail application is allowed.

ii) Applicant - Ketan s/o. Rajendra Ingle be released on bail, on furnishing PB and SB of Rs.50,000/-, with one solvent surety of the like amount, in the above crime for the aforesaid offences, on the conditions that, (a) He should not tamper with the prosecution witnesses. (b) He should attend the police station as and when called by the Investigating Officer on written notice. iii) Criminal Application No.3914 of 2024 stands disposed of. ( S. G. MEHARE ) JUDGE rrd
