WITH WRIT PETITION NO. 9648 OF 2014 Rambhau s/o Hari Rathod ...

Petitioner

Versus

The Dy. Commissioner of (Supply) Aurangabad Division, Aurangabad & others ... Respondents Mr. V.P. Savant, Advocate for petitioner Mr. D.R. Korde, A.G.P. for respondent Nos. 1 to 3 Mrs.A.M. Kulkarni, Advocate for respondent No. 4 .....

CORAM : RAVINDRA V. GHUGE DATED : 14th JANUARY , 2015 PER COURT :

1.

In the light of the objections of the respondent that an alternate remedy under clause 24 of the Maharashtra Scheduled Commodities (Regulation and Distribution) Order, 1975, is available, the petitioner seeks leave to withdraw these petitions on

9647.2014 + 1 WP instructions so as to avail of the alternate remedy and redress his grievance. Learned Advocate for the respondent Mrs. Kulkarni has no objection.

2.

In the light of the above, these petitions are dismissed as withdrawn with liberty as prayed for.

3.

Needless to state, in the event the petitioner faces a delay while availing the alternate remedy, the period consumed on account of the pendency of these petitions from 30-09-2014 till the passing of this order today, shall be a good ground to support the application for condonation of delay.
